Dot Dash Terms of Service
1. Who can use Dot Dash
Dot Dash accounts are for parents and legal guardians who are at least 18. A child uses the Dot Dash device under the supervision of the parent who paired it. By creating an account you agree to these terms and to our Privacy Policy, on your own behalf and for your child's use of the device.
2. Your account and your child's device
- Keep your password private. You're responsible for activity on your account.
- You choose who your child can message. That means Dot Dash friends you approve, and phone contacts you add (section 4). You can review your child's messages in the app and change their friends at any time.
- Give accurate information, and only add people you know and trust.
3. Acceptable use
Don't use Dot Dash to harass, threaten, or harm anyone. Don't send unlawful or sexual content, or content inappropriate for children. Don't impersonate someone else, send spam or bulk messages, or try to get into devices, accounts or messages that aren't yours. We may suspend accounts or contacts that break these rules, especially to protect a child.
4. SMS messaging terms
Program. Dot Dash SMS messaging lets an adult a parent has approved (a "phone contact") exchange messages between their mobile phone and a child's Dot Dash device.
It's optional. Using Dot Dash never requires anyone to receive SMS messages, and creating an account or agreeing to these terms is not consent to receive them. The only way to opt in is for the phone contact to send START themselves, as described below.
- Opting in. A parent adds the contact's name and number in the app, then invites them. The contact opts in by sending START to the Dot Dash number themselves. We never send a message to a number that hasn't opted in. After opting in, the contact gets one confirmation message.
- Message frequency varies. Messages are conversational, sent only when the child sends one from their device. Each one starts with the sender's name and "via Dot Dash", for example: Maya via Dot Dash: SEE YOU SUNDAY.
- Message and data rates may apply, depending on the contact's mobile plan.
- To stop, reply STOP to the Dot Dash number at any time. You'll get one message confirming you've been unsubscribed, and no more after that. To start again, reply START.
- For help, reply HELP, or email support@dotdashdevice.com.
- Carriers are not liable for delayed or undelivered messages.
- Messages sent to a child's device are shortened to fit its screen. Photos and emoji can't be shown on the device.
- A parent can remove a contact at any time, which ends the connection and deletes the contact's number (see the Privacy Policy).
- Mobile information is not shared with third parties or affiliates for marketing or promotional purposes.
5. The device and updates
The Dot Dash device updates its own software over Wi-Fi to fix problems and add features. The service needs a Wi-Fi connection and our servers to work, and we may change or improve it over time.
6. Messages and content
You and your child own what you send. You give us permission to store and deliver it only as needed to run Dot Dash. We don't use it for anything else.
7. Ending your account
You can delete your account at any time in the app's Settings. That unpairs your devices and erases your data, as described in the Privacy Policy. We may suspend or close an account that breaks these terms, and we'll tell you why unless doing so would put a child or anyone else at risk.
8. Disclaimers
Dot Dash is provided "as is". We work to keep it running, but we can't promise that every message will be delivered, or delivered on time. Dot Dash is not an emergency service. Don't rely on it to reach help in an emergency; call 911.
9. Limitation of liability
To the fullest extent the law allows, Dot Dash is not liable for indirect, incidental or consequential damages. Our total liability for any claim is limited to the amount you paid us for Dot Dash in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
10. Changes to these terms
We may update these terms. If a change is significant, we'll tell you in the app or by email before it takes effect. Continuing to use Dot Dash after that means you accept the new terms.
11. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
